Residence

Some time later they must have left Burin for Western Canada. They homesteaded near Wareman, north of Saskatoon and George James Marshall Jr. recalls his father telling him they first lived in a house of cedar logs, mud walls and a sod roof, typical of homesteaders' first dwellings. That they didn't go until about the turn of the century is likely as George's father told him that he remembers their going and that it was on the basis of correspondence with Josephine that he first went West in 1906 and eventually took his bride there in 1922.

"In St. Ann's Church, at 9:30 this morning, the wedding was solemnized of Loretta Patricia, daughter of Mr. and Mrs. George Marshall, and Mr. Patrick Thomas Monogue, son of Mr. and Mrs. Thomas Monogue. The Rev. Charles McColgan officiated. Given away by her father, the bride wore a white satin princess style gown, her fingertip-length veil caught to a white lace bonnet headdress. She carried white carnations and bouvardia. Only attendant for her sister, Miss Ann Marshall was gowned in raspberry tone moire taffeta, with headdress of white ostrich plumes, and she carried a nosegay of white carnations. Mr. Fred Bringleson was best man, and those ushering were Messrs. Samuel McMillan and Lorne Kemp. Floral decoration in the church consisted of asters and chrysanthemums. Miss Mary McCann was organist and accompanied Miss Mary Moynighan, Toronto, who sang.
A reception for 50 guests followed at Southgate. Receiving, the bride's mother was in a nut brown costume with hunter's green and gold accessories and Joanna Hill rose corsage. The groom's mother wore pencil blue with touches of black and Premier roses. Leaving for their wedding trip to Michigan, the bride wore a grey suit with black accessories, and her flowers were white carnations. Passed peacefully away at St. Patrick's Mercy Home June 2, 2015 age 79. Predeceased by her loving parents John (Jack) and Mary Marshall. Marie was a gifted musician whose talent and passion for the piano brought joy and inspiration to so many over the years. Her kindness and sweet disposition garnered many friends and admirers and her dry wit provided much humour for family and friends alike. She was a voracious reader and book collector, avid gardener and animal lover. She will be deeply missed by loving daughter Alexandra, adored brother John Marshall (Margaret), beloved sisters Angela Simmons (Jack), Madonna O'Grady (James) and Constance Marshall; nephews Tony Simmons (Krista) and John (Jay) Marshall (Renee); nieces Regina Connolly (Steve), Heather Pellatt (Tom) and Donna Donovan (Bill) and many other relatives and friends. The family would like to extend their immense gratitude to Mary Jane Bennett and the incredible staff of St. Patrick Mercy Home 3 East. Your kindness and empathy made a very difficult time much more bearable. Cremation has taken place at Marie's request. Funeral Mass will take place on Friday, June 5, 2015 at 9:30 a.m. from St. Pius X Church with inurnment to follow at Holy Sepulchre Cemetery. Flowers gratefully accepted or donations may be made to the S.P.C.A.³

There are several women named Mary Marshall during this time period, but I believe that the wife of Denis Burke, was Mary, daughter of Richard George Marshall and Mary Anne Penney.
Records that support this:
In the 1921, St. Jacques Census, "Mary Burke", widowed, states that she was born in Feb 1846 in Burin. Mary, daughter of Richard George, was baptized February 23, 1846.
Also, in the marriage record for Mary Marshall and Denis Burke, the witnesses are Richard Marshall and Isabella Marshall and Richard George had two children by these names who would therefore have been Mary's siblings.²

Mrs. Isabel Moignard of 5821 Grant Street, Halifax, died Friday in Victoria General Hospital.
Born in Burin, Newfoundland, she was the daughter of the late Richard and Mary Marshall. Most of her life was spent in Halifax where she was a member of St. Paul's Church and a charter member of the Halifax Chapter Seven of the Order of the Eastern Star.
Beside her husband, she is survived by one son, Albert; two daughters, Madeline, at home, and Doris (Mrs. Charles Longley); Halifax;, nine grandchildren and 19 great-grandchildren.
One son, Ernest, predeceased her.
The body is at Cruikshank's Funeral Home, Robie Street. Funeral Services will take place Monday at 10:30 a.m. From St. Paul's Church. Internment will be in Fairview cemetery."⁸

Personally, appeared before Mr. William Hooper Esquire, one of Her Majesty’s Justice of the Peace for the Said District – Robert Balson who upon his Oath saith that one night about 10 o’clock, in the early part of January last, Matthew Marshall came to the loft where deponent slept, he being there in bed, in coming into the loft, he inquired where deponent was and William St. Croix slept in the other Cabin, he then came and put his hand on deponent’s shoulder and said: Bob, you must get up and go along with me. The deponent dressed himself and went with him to his House, said was the house Marshall told deponent to come into the Parlours, when Matt Marshall told his wife to go out of the Room and as soon as she left Matt Marshall locked the door and put the key into his pocket and he then put a Book on the Table, which the deponent believes was a Prayer Book and a Pistol. Matt Marshall then said there is one thing I have to ask of you Bob, and you must do it or else the contents of this taking up the Pistol shall be sent through you. Deponent replied what is right I will do but what is not right I will not do. He told deponent it was no use to refuse. He must do it, for the oath he required deponent to take was that I would never take any liquor into his Mother’s House without he, his Father, or his Brother Richard should send him with it. Defendant said he never had carried any nor had he any means of getting to carry. Deponent did not take up the Book until Matt Marshall again pointed to the Book and told deponent to swear or he would shoot him or pass the contents of the Pistol through him. Deponent then through fear took up the Book and swore that he would not take any spirits to his mother’s.
Deponent was then going towards the door when Matt Marshall said there is one thing more I have to tell you that if I know that you carry Liquor into my Mother’s House unknown to me I will lay wait for you in the Path and have your Life, whom he defendant took the key from his pocket, unlocked the door and deponent went away and returned to the Loft where he slept, when he told William St. Croix what had passed at Matt Marshall’s house. Reason deponent did not make the case known was because he thought it could not be decided until the Judge came. Remembers to have told Robert Fudge of what had occurred within a day or two after it had occurred. On Sunday last the 2nd instant told his minister of what had occurred ant that he intended to apply to the Judge. He said, he had not before heard anything of it and told me to pitch it to the Devil. Deponent said that would not satisfy. Leaving On Sunday evening Matt Marshall wentaway in his ______________. (unreadable)

The Condition of the above Recognisance is such, That if the above bounden Robert Bolson shall appear at the ensuing Quarter Sessions or Circuit Court to prosecute Matthew Marshall for an alleged assault...

Burin, Newfoundland, Canada; This is the section of his father, John's will that specifies what he left him: And further I give and bequeath to my son Matthew Marshall all my interest in the Schooner "Milo" (now in his possession) together with all my right and title in the property which he now occupies and commonly known by the name as "Shandy Hall". I also give to my son Richard Marshall, all my right and interest in the schooner "Nautilus" (now in his possession). All the residue of my property (the foregoing conditions being complied with) shall be equally divided between my two sons Matthew and Richard Marshall consisting of all monies now in my possession or any where invested in public securities belonging to me with all my stock in trade, chattels, goods and effects and debts due me, provided that they, my aforesaid sons, shall pay all just debts due by me.⁹

Burin, Newfoundland, Canada; Merchant. Richard and Matthew (brothers) owned a business together - called M. & R. Marshall's. This was referred to in Matthew's will in 1857. The will also stated that Matthew or his children if he had died was to "buy out" Richard's portion of the business on 01 January 1864 for the sum of fifty pounds. This may have been the beginning of the commercial ventures of the Marshalls of Burin which seems to have just terminated (1990's) after 140 years. The will also mentions a salt store that they owned together. Both sons were also left the Schooners, the Milo (to Matthew) and the Nautilus (to Richard) so they obviously were also in the shipping/fishing business.; Principal=Richard George Marshall Esq.¹¹

"In the name of God Amen, I, Matthew Marshall the Elder of Burin, Newfoundland being of sound mind and body and right judgment do at my death give and bequeath all my lands, tenements, fishing rooms and appurtenances thereto belonging together with all monies belonging to me in manner following that is to say - I give to my children and my wife all my interest in the Union Bank of Newfoundland in the following manner - one share each to my children and two shares to my wife, in all eight shares to my wife. I also give my house and cabbage garden as her own personal property as long as she lives when it becomes my children's property. In the meantime they are bound to support her as comfortably as they possibly can while she lives. I give all and singular my other property to my other chidren as follows - my land and all the erections upon it to John Marshall, Matthew, Elizabeth and George, Thomas having property of his own, and as they are to keep it in repair as they come of age for their own benefit and for the benefit of their younger brothers and sister it is not to be sold out of the family without the consent of all my children and their guardians. In all my other property, vessels, boats and crafts, my son Thomas is to have an equal share. In case of the death of any of my children before they attain the age of 21 then their interest in all is to be equally divided between the survivors.
I give to my son Matthew my watch and my large plain gold ring with my initials inside. If my wife Frances marry again she is to get only one share in the said Bank she not to have no share in the aforesaid house, the share in the bank to be divided between my children John, Thomas, Matthew, George and Elizabeth, the house to be held jointly. My family are to pay my lawful debts as far as my property will go. Should my son Thomas die before he attains 21 years of age, all the property to him belonging as mentioned in my late father's will is then mine and I include it in my other properties to my children jointly but during his minority it is not to be sold or rented to any person or persons whatsoever except my children and it is to be kept in as good order as it is at present by my children until he come of age - and all and singular my stock in trade, money in my _____ or in public securities or in private account, chattels, goods and effects and all debts due to me.
The trade now carried on between me and my brother Richard under the name and firm of M. & R. Marshall - hold the property, goods, money, stock and debts due to the said firm are mine, notes of hand, bonds and everything of this sort or in anywise appertaining which I bequeath to my children as aforesaid John, Thomas, Matthew, George and Elizabeth. At the same time they are to pay all my lawful debts of the said trade of M. & R. Marshall out of the said goods and property that may be contracted until 1858. The new salt store built by my brother Richard Marshall and me at a mutual expense is to be used for the use of the trade only while the trade continues as it is at present with the exception of the linkay (linney?) attached to it. That is my own property at present and built entirely at my own expense and the trade have nothing whatever to do with it. In case of separation the salt store to be managed as follows - to be divided through the centre below lengthwise and through the centre across upon the loft each party to put whatever sort of loft he may think proper in his respective end and to leave the same in it, both parties to have an equal use of the wharf until the first of January 1864. Then it becomes my children's property and it is not to be sold only on the same conditions of the aforesaid peoperties. But my children or Executors are to pay my brother Richard at the expiration of the time mentioned January 1, 1864 the sum of fifty pounds currency as per agreement between him and me both parties keeping it in order up to that time.
I appoint the Rev. John Cullen, William Hooper, Esq. and John O'Neil to be my true and lawful executors to carry out the conditions of this my last will and testament. In witness whereof I here unto subscribe my name and affix my seal this eighteenth day of March in the year of our Lord one thousand eight hundred and fifty seven.

My note: Matthew had another living daughter, Mary, but she had already married when he wrote this Will.¹¹

Burin, Newfoundland, Canada; It is interesting that in the Probate Records that Frances, Matthew's wife, stated he did not have a Will as there was one written in 1857. Had Matthew written it, submitted it, and then tore it up?

These are the important parts of the Probate Records:
"I, Frances Marshall do swear that I believe Matthew Marshall late of Burin in the Southern District, Trader, deceased, died without a Will and that I will well and administer all and every the Goods of the said deceased...to the best of my knowledge, judgement, and belief, amount to the value of seventeen hundred dollars. Sworn before me at St. John's the 21st day of June in the Year of our Lord One Thousand Eight Hundred and Sixty Six. (Signed by Thomas Marshall, not Frances Marshall)." Frances was granted Administration rights on that day.

"To the Honorable Hugh W. Hoyles Chief Justice of the Supreme Court of Newfoundland. The Petition of Frances Marshall of Burin in the Southern District of the Island of Newfoundland and Widow. Humbly Sheweth That the late Matthew Marshall died at Burin aforesaid on the tenth day of February last, intestate. That he left him surviving your petitioner, two daughters and four sons, that is to say, Mary Dubordieu, a widow, and Eliza, and John, Thomas, Mathew and George. That at the time the testator of the said Intestate he was possessed of property, real and personal of the probably value of four hundred pounds equal to one thousand six hundred dollars. Petitioner therefore humbly prays that your Lordship will be pleased to grant her letters of Administration of her said husband. And as in duty bound will ever pray. (Signed) Frances Marshall."

No inventory of property was included in the Folio.¹⁰
