| (Witness) Court Case | 4 October 1842 | Burin, Burin Peninsula, Newfoundland, Canada; Transcription of Court Documents: Southern District Burin Personally, appeared before Mr. William Hooper Esquire, one of Her Majesty’s Justice of the Peace for the Said District – Robert Balson who upon his Oath saith that one night about 10 o’clock, in the early part of January last, Matthew Marshall came to the loft where deponent slept, he being there in bed, in coming into the loft, he inquired where deponent was and William St. Croix slept in the other Cabin, he then came and put his hand on deponent’s shoulder and said: Bob, you must get up and go along with me. The deponent dressed himself and went with him to his House, said was the house Marshall told deponent to come into the Parlours, when Matt Marshall told his wife to go out of the Room and as soon as she left Matt Marshall locked the door and put the key into his pocket and he then put a Book on the Table, which the deponent believes was a Prayer Book and a Pistol. Matt Marshall then said there is one thing I have to ask of you Bob, and you must do it or else the contents of this taking up the Pistol shall be sent through you. Deponent replied what is right I will do but what is not right I will not do. He told deponent it was no use to refuse. He must do it, for the oath he required deponent to take was that I would never take any liquor into his Mother’s House without he, his Father, or his Brother Richard should send him with it. Defendant said he never had carried any nor had he any means of getting to carry. Deponent did not take up the Book until Matt Marshall again pointed to the Book and told deponent to swear or he would shoot him or pass the contents of the Pistol through him. Deponent then through fear took up the Book and swore that he would not take any spirits to his mother’s. Deponent was then going towards the door when Matt Marshall said there is one thing more I have to tell you that if I know that you carry Liquor into my Mother’s House unknown to me I will lay wait for you in the Path and have your Life, whom he defendant took the key from his pocket, unlocked the door and deponent went away and returned to the Loft where he slept, when he told William St. Croix what had passed at Matt Marshall’s house. Reason deponent did not make the case known was because he thought it could not be decided until the Judge came. Remembers to have told Robert Fudge of what had occurred within a day or two after it had occurred. On Sunday last the 2nd instant told his minister of what had occurred ant that he intended to apply to the Judge. He said, he had not before heard anything of it and told me to pitch it to the Devil. Deponent said that would not satisfy. Leaving On Sunday evening Matt Marshall wentaway in his ______________. (unreadable) Robert Balson, his mark Sworn before me on this 4th October 1842 Will Hooper, J.P. ------------------------------------------------------- Be it remembered that on the eighth day of October in the Fifth Year of the Reign of our Sovereign Lady Victoria...and in the Year of Our Lord One Thousand eight hundred and forty two: Robert Bolson Personally came before William Hooper and Henry Butler Esquires, two of Her Majesty's Justices of the Peace...The following Sum, that is to say, the said Robert Bolson, the sum of Ten Pounds, lawful Money of Great Britain, to be made and levied of his Goods and Chattels, Lands and Tenements respectively, to the use and behoof or our said Lady the Queen...if the said Robert Bolson shall make default in the condition under written. Billy was a longtime employee of ZBR Publications/ Globalware Solutions in Wilmington/Haverhill before his retirement. He was a member of the Billerica Lodge of Elks. Billy is survived by his son, James M. St. Croix and his daughter, Leanne St. Croix Fredrikson, both of Billerica; his brothers, Henry, Ritchie, Johnny and Bobby St. Croix; his sisters, Doris Speranza, Janice Mulloy, Jackie Krassnoff, Mary Cardinale, Theresa LeBlanc, Marjie Roberts and Jeannie Recupero. He was the brother of the late Carol Mason and Ruthie Recupero and father-in-law of the late Erik Fredrikson Jr. He leaves many nieces, nephews, and friends. | Court Case | 29 September 1872 | St. John's, Avalon Peninsula, Newfoundland, Canada; Case came to the Supreme Court: Matthew McGuire - Plaintiff vs. Defendant - William St. Croix (Sancroix) McGuire was suing for $100 for breach of agreement. Deposition of William St. Croix: Examined by Mr. Norton (?) for defendant: "I am the defendant in this action. I know the plaintiff. I live and carry on a buisiness in Holy Rood St. Mary's Bay. McGuire, the plaintiff, brought some fish for me from Holy Rood to St. John's. This vessel came on time. I first saw McGuire at the River Head of St. Mary's. I then agreed with him to bring some fish and oil for me to St. John's. I agreed with him then to give him a full load of fish and oil. He did not bring a full load. I did not stop there whilst he loaded his vessel. I came on to St. John's He arrived at St. John's after I came. I saw McGuire in St. John's and I asked him why he did not bring on all the fish. He said he would go again for the remainder. i don't remember what reason he gave for not bringing all the fish. This was sufficient fish for a full load if he wanted to bring it. The first lot of fish was delivered at Edward Smith Co. McGuire was paid the freight for the first lot. He made no claim of any kind on me in respect of the first trip. He brought something over four hundred quitals of fish the first time. There was an understanding to me that McGuire was to go for the rest of the fish. The conversation took place between us on E. Smith & Co. wharf. Mr. Smith was present. At that time he had not been paid the freight of the first fish. All that passed between us was I asked him what was the reason he did not bring all the fish he said I will go after the rest. I said to McGuire I don't know what quantity of my fish may be there but he (?) may get some fish from others. I did not mention any particular quantity of any more fish. I was glad for him to go for my fish and I expected he would get fish from others. He did not go on these conditions he was glad to go for my fish. I did not promise or undertake that he would get other peoples fish. I did not from me any quatity would be made up for him. The only understanding was that McGuire was to bring the remaining quantity of my fish whatever that might be. The second quatity of fish and oil was to be delivered to E. Smith & Co. Mr. Smith was to pay the freight and be charged to me. E. Smith & Co. paid the first freight. McGuire left St. Johns to fo for the rest of the fish and oil whilst I was here. I saw him afterwards on Holy Rood. I was not there when he left to come on to St. John's. He was not doing anything when I saw him. His vessel was not taking on fish when I was there. I did not stay on Holy Rood when the vessel was loading. There was 108 quintals of fish there for him to take and five casks of oil. McGuire said nothing to me on Holy Rood about the load or the quatity of fish or anything else. I gave orders to put on board what fish and oil was there. McGuire did not come to me for the freight until about ten days ago. He never wrote to me or sent me any demands for the freight before this or made any other demand upon me. The only agreement I had with McGuire was what I have already stated. Examined by W.. McNeily: McGuire brought over 400 quintals of fish the first time. I had more fish for him the first time than he was able to take. I can't judge how much his craft could take. I had the full of her the first time whatever she could take. His craft was not full when he came on the first time. I told him the second time that there were other parties there whose fish he might get but I was not sure whether he would get them or not. I can't say whether I told him I was not sure. I was not there to engage him for other peoples fish. Taken and Sworm before me at St. John's Newfoundland, this 22nd day of October 1872, William St. Croix The case was judged to be a nonsuit with the defendant costs of $25 on 30 December 1872.6 |
| Court Case | 8 October 1872 | St. John's, Newfoundland, Canada; Two suits were brought into the Central Circuit Court of NL against William St. Croix. The case was later sent to the Supreme Court. 1. By Thomas Kelley for allegedly owing him $100 (equal to 25 pounds). He claims 19 pounds for wages per agreement and 6 pounds for Board and Lodging from July 27th until October 10th. Judgement for Seventy two dollars and thirty six dollars and seventy five cents for costs. 2. By John Kelley for allegedly owing him $88 (equal to 22 pounds). He claims 16 pounds for wages per agreement and 6 pounds for Board and Lodging from July 27th until October 10th. Judgement for Fifty Seven dollars and thirty six dollars and seventy five cents for costs. Deposition by William St. Croix: (Examined by Mr. McNeily) I am the defendant in the above cases. I know the Plantiffs. They were shipped by me (Agreement admitted). I required them to serve persons under me. John Kelley was to serve Peter White a dealer of mine. Thomas Kelley was to serve Michael Tobin, also a dealer of mine. The plantiffs entered into the employ of their respective masters. John Kelley came to me the 21st of last July. He came to me looking for his wages. I told him I was not going to give any wages that day of the year. He said nothing to that. Peter White lived at Point Lahay about seven miles from Holy Rood. I live at Holy Rood. After I refused to give him his wages he remained two days at Holy Rood. I don't know where he went then. I went to his master, he (John Kelley) was not there. I think it was the same day that he came looking for his wages that I went to Peter White. I don't know whether John Kelley said anything about his going to leave when he came for his wages. I can't say whether he stated his master had discharged him. He went away shortly afterwards. Three or four days after. Thomas Kelley did not complete his time with Michael Tobin. Thomas went away along with John. He did not come to me before he left. (Examined by Mr. Winter) I don't remember the day of the week John Kelley came to me. I know it was the 21st of July. It might be a Monday on our place. I remember Thomas coming to me on a Sunday for a pair of boots. It was before John came for his wages. I did not give him the boots I told him that I would not give him anything. I did not intend to give him anything throughout the summer. I don't know when they were done fishing with cod nets this summer. There was ___ little fish got with the cod nets. I said to John I am not going to give you any wages if you are not going to stay with your master. Take your share of the fish. At that time I did not know but that his master discharged him. I did not say anything of that sort to Thomas Kelley. One other man left and got paid his wages for the time he served. I object to pay these men, the Kelleys, the than wages or any part thereof as I did not turn them away. They were two days on Holy Rood away from their masters. John Kelley was in Holy rood away from him his master but I did not see him. Thomas did not come to me for his wages he was not in Holy Rood. It was Sheehan and John Kelley who were in Holy Rood for the two days. Richard Sheehan left with his master's consent. Taken and Sworn before me at St. Johns, Newfoundland the 22nd day of October 1872. Evidence of Michael Tobin, a witness for the Defendant, in the case of Thomas Kelly V. William St. Croix: I live at Point La Haye. I know both the Plaintiff and Defendant. William Defendant shipped Plaintiff as a servant for me this summer. Defendant was to get Ninteen Pounds wages, for serving me from tenth May until tenth of October. Defendant did not stay with me until that time. Defendant left me between the twentieth and twenty fifth of July, I did not discharge him. I requested him to stay in my service. I know he took up a trifle I do not know how much. Although I wanted him to stop he persisted in leaving my service. Mr. Smith had to pay him his wages upon recieving an order from St. Croix. I am a dealer for St. Croix. It was Sancroix, Deft., that shipped Ptf. I was in the office too. It was a _________?? I ____? not let him if he never stop with me. I have to pay Deft. any wages Kelly recovers from him. I wanted Plf. for many a thing I had to do for him. I don't know why he should want to leave his service as he was on wages. A ____? before Plf. left he went to see Sancroix. I don't know whether he saw him after. I don't know what occurred at any time between Plf. and Defendant. I did not tell him to go. I told Plf. nothing at all about it. I wanted him to stay. I said he'd have some chance of getting his wages if he stop until his time was up. Ptf. was only in want of boots they were not very bad. I had no boots to give him and nothing else to give him. Sancroix had to give him all, I don't know whether he asked Sancroix. I don't know what passed between him and Sancroix. It was left he had to work to get his wages. ReEx: I don't know whether St. Croix told Kelly or not that I was to be his master. He know that he was going to serve me, but he would have had to serve anybody else if St. Croix had told him up till the time he left he did everything I told him. Winter of St. John's, aforesaid attorney for the plaintiff maketh oath and saith that on the thirty first day of October last, the sum of Seventy Six dollars was paid to Court upon an order made in the Central Circuit Court to abide the ___? in this cause. That on this twenty eighth day of November instant final judgement for the plaintiff in this cause was signed for Seventy two dollars and Thirty six dollars and seventy five cents for costs of suit. That there is not to the knowledge and belief of defendant any adverse claim upon the fund in court in this cause. ...28 November A.D 1872 John Kelly vs. William St. Croix, Supreme Court The evidence of Peter White a witness for the defendant take de bene Esse before - Peter White Sworn Examined by Mr. R. McNeily. I know William St. Croix he shipped John Kelly. John Kelly was shipped to serve me four months. He did not serve me four months. He served me from the fifteenth of May until the twentieth or twenty fifth of July. He left me and went home to St. Johns. I did not give him any reason to leave me, only that there was no propect of getting a voyage. I wanted him not to go. I wanted him to work until the first week in August and then if there was no fish I would let him go. He was to get Sixteen Pounds wages for serving me for four months. I did not discharge him, he left without my consent, was not paid any portion of his wages that I know of, only what he took up in the Spring of the year. I don't know how much he took up. I don't know that Sancroix shipped John Kelly - he brought him to me. He shipped him for me. Sancroix was supplying me. I was Kelly's Master. It was a bad voyage. I don't know why he ___? wish to leave because it was a bad voyage. I live at Point La Haye. Deft. lives at Holyrood about nine miles away. Kelly left me to see Sancroix the Defendant. Kelly did not ask me to let him go. He was for going. I thought to stop him and he would not be stopped by me. He said what was his use of stopping with me as we was getting no fish. Deft. was to pay him his wages. I don't know what occurred between Kelly (the Plf.) and the Defendant. ReEx.: I suppose I would have been charged with Kelly's wages if St. Croix had paid. There were several men named William St. Croix but because it states that this William was from St. Mary's Bay and a planter, I am including the information here. | Court Case | 18 May 1875 | St. John's, Newfoundland, Canada; A court case was presented to the Supreme Court following a suit by the plaintiff, Daniel Bishop, against the defendant, William St. Croix planter of Holyrood. William contended that on the first plea he was not indebted to Daniel Bishop. On the second plea, he stated that he had delivered to Daniel, a promise, in writing that he would pay him 7 pounds currency on the 16th August 1874 and that it was accepted by Bishop and the claim discharged. On the 3rd plea, William says that he levied a plaint in the District Court of St. John's against Bishop for recovery of the balance of account due him by Bishop and that Bishop relied on a "set Off being the debt now sued for in this action and that the court found that there was nothing due and actually recovered from Bishop twenty six dollars and fifty and his costs of suit. William is claiming that Daniel Bishop owes him sixty-seven pounds ten shillings equal to two hundred and seventy dollars for goods sold to him at his request. A receipt is recovered from the District Court for the set off that William St. Croix bought 1 brl. flour ($10), 1 brl. meal ($6.60), 4 gal. molasses ($3.20), 3 lbs. tea ($2) and leather ($0.60) for a total of $22.40 and that there was an old debt of $280.00. Paid for work $8.40. Daniel presented that William owed him $40 for fish and oil sold and delivered. The court found that William did indeed now owe Daneil Bishop $30.50. William did pay the debt of $31.75 (court costs included) on November 6, 1875.; Principal=Daniel Bishop9 |

I bequeath my Soul to God and my Body to the Earth. 2. I bequeath and devise to my Son Stanislaus and Son Albert Joseph, the plantation and premises situate at St. Mary's aforesaid with all the Water privileges and appurtenances thereunto belonging to the said plantation being commonly called and known by the name of Ridout's Room (hard to read the name) and which estate had been conveyed by Deed, Signed, Sealed and Delivered by me to my dear Brother, Peter St. Croix, for a consideration in trust for my said dearly beloved Sons Stanislaus and Albert Joseph. 3. It is my sincere and earnest wish that the firm in St. John's known as that of Messrs. J.B. Brothers of Merchants (hard to read), in case of my demise, shall take possession of the Estate above mentioned for the Sum of two hundred dollars per annum which sum of two hundred dollars is to be applied to the maintenance and education of my children. 4. I devise to my dear mother Mary Patrick St. Croix, my mare, carriage, sleigh and harness there unto belonging. 5. I give and bequeath the sum of about Seven hundred dollars deposited in the Newfoundland Bank in the name of my demised and lamented wife, Honora, to my two daughters, named Mary Ellen and Frances now residing with me for their sole and especial benefit. 6. I give and bequeath to my youngest son William in case of my demise the sum of one thousand dollars, being the money of Insurance effected on my life in the Etna Life Insurance Company of Hartford, Connecticut. With the provision that the sum of two hundred and eighty dollars or thereabouts ___ debts contracted by me should be paid from said sum of one thousand dollars. 7. I wish that the ____ in my possession, to wit, "Ivanhoe, ___, Isabell and Randsom" with all the gear and appurtenances apportaining to said draft shall be given unto Messers. J. B. Brothers of St. John's together with all the traps and leaders and all committed therewith with all the Stock in trade shall also be delivered unto the said Mrs. Job Brothers. 8. I give the House and Fishing Room in Holyrood, St. Mary's to my brother, Peter St. Croix to have and to hold the same for the term or space of fourteen years for his use and benefit for that period, then to devolve to my sons Stanislaus and Albert Joseph, aforementioned. 9. | Obituary | May 2011 | St. George's, Newfoundland, Canada; Zackery Thomas St. Croix It is with deep sadness that the family of the Late Zackery Thomas St. Croix announce his passing on Tuesday, May 24, 2011 in St. George’s, NL at the age of 15 years. Zackery will always be remembered and loved by his parents Lorie McFatridge and Eugene St. Croix; grandparents: Eugene and Theresa St. Croix, Leona Swyers; great-grandmother Melinda Bennett; Aunts: Selina Swyers, Thelma Hannaford (godmother), Emma Alexander, Anita Muise, Roxanne St. Croix; uncles: Chuckie Bennett, Ron Swyers, Kenneth St. Croix, Cliff St. Croix, Guy St. Croix (godfather). He will also be dearly missed by his second set of parents Sharon and Danny Cormier, best friend Mitchell, many cousins, teachers and friends. Visitation will take place from Fillatre's Funeral Home on Thursday from 7 – 9 p.m. and Friday from 2 – 4 and 7 – 9 p.m. The funeral service will take place from St. Joseph’s Parish in St. George’s, NL on Saturday, May 28, 2011 at 2:00 p.m. with Father Gerard Patry officiating. Cremation will take place at Humber Valley Crematorium following the Service. As expressions of sympathy donations may be made to the Stephenville Minor Hockey Association through Sharon Cormier. Funeral arrangements entrusted to Fillatre’s Funeral Home, Stephenville Crossing. The family guest book may be signed or a memorial donation may be made through our website www.fillatre.ca1 |

Mary's husband, Richard J., is buried in the old, old one in the family plot as is his mother and father (Alfred and Teresa - nee Reddy).1 |
