Court Case13 October 1879 St. Jacques, Fortune Bay District, Newfoundland, Canada; Supreme Court, 13 October 1879 – Dennis Burke vs. William Skinner, both of St. Jacques.
In 1846 William Skinner moved to St. Jacques, Fortune Bay, and the following year he married a widow, Mrs. Evans. She possessed land which he cultivated. Between his fields was wasteland and a public path that led from the road from Belleoram to the landwash. The path was used for hauling wood and in the winter for hauling ice for the American bank fishery. In 1875 William Skinner claimed the public path was his and he blocked it with a fence. The residents complained to Magistrate Philip Hubert and he told them to knock it down. Dennis Burke removed the fence but Skinner put it back up. Burke and his servants were greatly delayed in hauling ice from the ice house. Some of the American Bankers left because they did want to wait for the ice. Dennis Burke lost income and he sought $500 in damages.
Michael Burke, aged 49 years, moved to St. Jacques about 1834. He testified that public path was the only way to the sea shore and it was used when he was a boy. Isaac Penny, aged 66 years; James Young, aged 49 years; Stephen Cluett, aged 44 years; and Samuel Dicks, aged 42 years, also testified that the path to the shore was always public.
On 9 August 1881, the Court awarded Dennis Burke $289.30 in damages.; Witness=Michael Burke7
