Eleazer Galloway's grandson James Eleazer Galloway, son of William E. Galloway, deceased, petitioned the Henry County Probate Court in January 1865 to set aside the November 1864 sale of Eleazer's land to Elizabeth Driggers and Rosier Brannon, citing several particulars having to do with insufficient notification to heirs of intended sale. James Eleazer was in the Army at the time of the sale, and several grandchildren lived out of state. Petitions alleged that none of the out of state heirs (all grandchildren) were notified of the sale, and that there was no official notification to Rosier Brannon yet he was a winning bidder. James Eleazer Galloway was a minor still, and enlisted his "next friend" James D. Murphy to represent him in the case. James D. Murphy, son of Daniel and Elizabeth Murphy, lived adjacent to Eleazer and Leaty Galloway in 1860. James Murphy submitted all the petitions to the court on behalf of James Eleazer Galloway. It's not clear whether James Murphy had legal training (he identified himself as a hatter in the 1860 census) or whether they hired an attorney, but their petitions were well written.

The Henry County Probate Court in a special term November 3, 1866, refused to set aside the original sale. James Eleazer appealed to the Alabama Supreme Court. On 17 July, 1867, the court affirmed the ruling of the Henry County Probate Court, and awarded fees of $200. to Edward J. Galloway, administrator of the estate, to be paid by James D. Murphy.

Rozier died February 9, 1867, before this case was concluded.14

Journal*Leaty Parrish; Eleazer Galloway of the Darlington County region of South Carolina is the earliest known Galloway ancestor for the Balkcom line of western Oklahoma and southeast Alabama. Eleazer and his wife Leaty Parrish were early settlers in Henry County, Alabama and came to own substantial land there. Their link to the Balkcom line is through their daughter Anzilla Galloway who married Rosier Brannon of Henry County, formerly of Duplin County, North Carolina, in 1826. Rose Ann Brannon, a daughter of Rosier and Anzilla, had a son John Ira Balkcom who with his young family moved from Alabama to Texas in around 1901. After only a few years in Van Zandt County, Texas, they moved to Hollis in western Oklahoma. 
CommentEleazer shows up infrequently as a given name and may provide clues about ancestors. Eleazer was an occasional surname in the Lexington District of SC in the early 1800s. Biblically, "The chief leader of the Levites was Eleazar son of Aaron, the priest. He was appointed over those who were responsible for the care of the sanctuary."4 
My ResearchNote*Absalom Galloway; South Carolina, USA; Absalom Galloway is unlikely as a candidate for Eleazer Galloway's father. Absalom's will names his current wife, refers to earlier marriage and children of the marriage, names children, but does not name Eleazer. Absalom died between 1793 (date of his will) and probably 1800. Eleazer was born c1787 so as a minor in 1793 should have been named in the will.

My ResearchNote*Abraham Galloway; South Carolina, USA; Abraham Galloway #1821 has, based on paper records, seemed the best candidate for father of Eleazer Galloway because he is shown to have been in Camden and Cheraws Districts before 1790 and he is of the the Galloway family that had substantial land around Lynches Creek. One source alleges that Eleazer was from the Lynches Creek area. In the 1800 census Abraham had a male age 16-25 in the household, in the range for Eleazer although Eleazer's birth date is uncertain.

(Witness) NoteAbraham Galloway; Probable children of Abraham Galloway #1821 are Abraham Galloway #1912 on this site, Eleazer Galloway #1312, and William Galloway #1442. I have not found the paper records to confirm this family and have not found confirmation by other researchers. However, dna tests match my family (descendants of Eleazer Galloway) with a descendant of Abraham Galloway #1912, called Abraham Galloway Jr. in most public trees. If this Abraham is the son of Abraham #1821 then the strong implication is that Eleazer and Abraham Jr. are brothers and that Abraham #1821 is their father, mother unknown.

Hoyt Warren's book is more specific that Eleazer was from the Lynches Creek area, near where Lynches Creek and Little Lynches Creek merge. Birthdate uncertain, 1880 per 1850 census, 1887 per 1860, and 1890-1899 per 1830 census.5,6,7

Household makeup is consistent with this person actually being Eleazer Galloway. A neighbor comparison between 1820 and 1810 cannot be done since the 1820 census taker put the names in alphabetical order. Elijah's immediate neighbors were Edward Parrish Jr. and William Parrish, a son of Edward's. Nearby were Jeremiah Parrish Sr. and Jeremiah Parrish Jr. and families.10 
Military*14 September 1813Georgia Militia, War of 1812, Twiggs County, Georgia, USA; from the "Payroll of the 1st detachment of militia ordered out on the frontier of Twiggs County in pursuance of orders from Brig General David Blackshear dated 7 August 1813 for the protection of the inhabitants residing on the Ocmulghee, and to build Fort Jackson." Private "Eleazer Galloway" appeared on a roster in Lieutenant Lovett B. Smith's Company, apparently as a "defaulter", no pay was listed. He doesn't appear in service records at the National Archives for volunteers who served in this war. Several South Carolina Galloways served in South Carolina and Georgia regiments for short periods of time. This particular detachment seems to have been drafted into service.11

William's petition asks the court to " ... require Roger Parish to show cause why he should not make final settlement ..."

On 22 April, the court ordered Roger Parrish to appear before the court to show cause why he does not make final settlement.22

In a case before the Alabama Supreme Court, January Term 1859, Roger Parrish, identified as brother of Anna Parrish and administrator of her estate, filed an appeal from the Chancery Court of Henry County. The appeal dealt with whether Anna, who had inherited slaves on her father Edward's death, owned the slaves outright and whether she had authority to do so when she later deeded the slaves to Eleazer Galloway. Eleazer then released his interest in the slaves to William Parrish. The Henry County Chancery Court ruled that Anna did own the slaves outright. Roger Parrish contested this ruling to the Supreme Court. The summary of this case identifies relationships between the parties:

"Eleazar Galloway" was identified as the original complainant in Henry County court;
"William Parish and Roger Parish, ... were the brothers of the complainant's wife";
"Anna Parish, deceased, who was a sister of the complainant's wife";
"The defendant Roger Parish ... administrator of Edward Parish, deceased, who was the father of said Anna, William, and himself ..."

My ResearchNoteThere are no tombstones in Henry or Dale Counties for Eleazer or Leaty Galloway. I think it likely they are in one of the areas of Old Center Methodist Church Cemetery that is missing markers. This cemetery was near where they lived and where many in the family are buried.

Eleazer Galloway's grandson James Eleazer Galloway, son of William E. Galloway, deceased, petitioned the Henry County Probate Court in January 1865 to set aside the November 1864 sale of Eleazer's land to Elizabeth Driggers and Rosier Brannon, citing several particulars having to do with insufficient notification to heirs of intended sale. James Eleazer was in the Army at the time of the sale, and several grandchildren lived out of state. Petitions alleged that none of the out of state heirs (all grandchildren) were notified of the sale, and that there was no official notification to Rosier Brannon yet he was a winning bidder. James Eleazer Galloway was a minor still, and enlisted his "next friend" James D. Murphy to represent him in the case. James D. Murphy, son of Daniel and Elizabeth Murphy, lived adjacent to Eleazer and Leaty Galloway in 1860. James Murphy submitted all the petitions to the court on behalf of James Eleazer Galloway. It's not clear whether James Murphy had legal training (he identified himself as a hatter in the 1860 census) or whether they hired an attorney, but their petitions were well written.

The Henry County Probate Court in a special term November 3, 1866, refused to set aside the original sale. James Eleazer appealed to the Alabama Supreme Court. On 17 July, 1867, the court affirmed the ruling of the Henry County Probate Court, and awarded fees of $200. to Edward J. Galloway, administrator of the estate, to be paid by James D. Murphy.

Rozier died February 9, 1867, before this case was concluded.3

he lived happily till 18th June last, at which time she was taken away by the hand of God. He was the father of nine children, all of whom he lived to bring up to mature age, and all of whom he left to mourn their irreparable loss. He was a kind father and husband, a good citizen, and an excellent neighbor .... He joined the M.E. Church some forty years ago, and continued a zealous and faithful member till the day of his departure from earth .... He was afflicted with that distressing disease, hydrothorax, for several months, while sitting upright, was compelled to labor hard for the breath of life .... He seemed conscious that his end was close at hand for several days previous to his dissolution, and often while suffering the most intense pain, praised God aloud, and said he should soon go to reap his reward and to meet his dear departed companion in heaven. He retained his rationality in the highest degree down to his last moments, and while sitting in his chair, at 3½ o’clock p.m., grasped me by the hand, and his ransomed soul immediately took its flight and went up to heaven in a perfect blaze of glory...... A pension application in Henry County, 1920/12/04, by Lucy V. Gallaway (widow) states that indicates that Hillary J. Gallaway entered the unit April 1862, was wounded at The Battle of Perryville, Ky, and left the service at Greensborough, North Carolina 1865/04/27. I see no records of a Henry County Hillary Gallaway married to a Lucy and it's not clear that these Hillarys are the same person. I see only one Hillary Galloway in Henry or Dale County in the pre-Civil War time frame.
