(Witness) NoteAbraham Galloway; Probable children of Abraham Galloway #1821 are Abraham Galloway #1912 on this site, Eleazer Galloway #1312, and William Galloway #1442. I have not found the paper records to confirm this family and have not found confirmation by other researchers. However, dna tests match my family (descendants of Eleazer Galloway) with a descendant of Abraham Galloway #1912, called Abraham Galloway Jr. in most public trees. If this Abraham is the son of Abraham #1821 then the strong implication is that Eleazer and Abraham Jr. are brothers and that Abraham #1821 is their father, mother unknown.

Extract of Deed, James Galloway to Absalom Galloway: "...witnesseth that for and in consideration of twenty Pounds Sterling money of the said state to him in hand paid by the said Absalom Galloway at or before the signing sealing and delivering of these presents the receipt of which I the said James Galloway do acknowledge and have granted bargained sold and delivered and by these presents do bargain sell deliver and confirm unto the said Absolom Galloway in his actual possession now being by virtue of a bargain and sale to him for twenty pounds to him his heirs assigns forever a tract of land containing one hundred and ninety six acres part of two tracts and for the said Galloways [transcriber's note: there is no punctuation in Galloways] mother Rebecca Galloway is to have her life time in this said tract situate in Darlington County on the north side of Linches Creek granted to James Galloway bounded on William Barreks line together with all the houses, barnes, edifices, buildings, gardens, orchards, ferrys, waters, water courses, prophets, commodities, hereditament appurtenances thereunto belonging or in anywise appertaining to the said one hundred and ninety six acres of land herein mentioned the ditch to be the line between the two and all other lines agreeable to the three brothers with all the rights titles, true trust possession benefits property plains and demands whatsoever of him the said James Galloway to have and to hold the said one hundred and ninety six acres of land with all and singular the premises before mentioned unto the said Absalom Galloway his heirs and assigns forever ....

Alexander #2138 of Fairfield County in 1800 seems a somewhat more likely choice given Fairfield County's closer location to the service locations listed. Alexander #1934 of York County also seemed to have a close link to Peter of York County, and I believe that the York Peter is not the one who served in the Revolution.

Eleazer Galloway's grandson James Eleazer Galloway, son of William E. Galloway, deceased, petitioned the Henry County Probate Court in January 1865 to set aside the November 1864 sale of Eleazer's land to Elizabeth Driggers and Rosier Brannon, citing several particulars having to do with insufficient notification to heirs of intended sale. James Eleazer was in the Army at the time of the sale, and several grandchildren lived out of state. Petitions alleged that none of the out of state heirs (all grandchildren) were notified of the sale, and that there was no official notification to Rosier Brannon yet he was a winning bidder. James Eleazer Galloway was a minor still, and enlisted his "next friend" James D. Murphy to represent him in the case. James D. Murphy, son of Daniel and Elizabeth Murphy, lived adjacent to Eleazer and Leaty Galloway in 1860. James Murphy submitted all the petitions to the court on behalf of James Eleazer Galloway. It's not clear whether James Murphy had legal training (he identified himself as a hatter in the 1860 census) or whether they hired an attorney, but their petitions were well written.

The Henry County Probate Court in a special term November 3, 1866, refused to set aside the original sale. James Eleazer appealed to the Alabama Supreme Court. On 17 July, 1867, the court affirmed the ruling of the Henry County Probate Court, and awarded fees of $200. to Edward J. Galloway, administrator of the estate, to be paid by James D. Murphy.

Rozier died February 9, 1867, before this case was concluded.19

Land Grant*24 August 1770150 acres bounding southward on Lynches Creek, Craven County, South Carolina, USA; An indenture of sale of land in 1771 refers to "a plantation or tract of land containing 150 acres situate in Craven County granted by his Majesty to the above named Benjamin Galloway as appears in the original grant thereof bearing date the 24th day of August 1770";

A second reference (Memorials ...) registers a land title, apparently this same land, on 14 October 1771, describing it further "..containing 150 acres bounding southward on Lynches Creek on all other sides on vacant land originally granted the 24th day of Aug 1770 unto Benjamin Galloway at 2t Nt of 3/St for 4/pro money ..."

It may be that Benjamin may have registered the land in order to sell it, but I don't have the full transcript from the first source. I do have the entire transcript from the second source.1,2

Witnesses were Nathaniel Piggott, Thomas Welch, and Charles Campbell. Transcriptions of these documents are attached. Land location is stated only generally, but it appears from the language that it abuts land of John Piggott. The documents name Benjamin Galloway's occupation as planter, his wife's name as Sarah, and describe the land as granted to him in 1770. There is no explanation for the extremely low selling price. Is it possible that this was a transfer within the family, say as if John Piggott were Sarah's father or brother?1

    "After South Carolina was purchased from the Lords Proprietors and became a royal colony in 1729, the crown had legislation enacted to help facilitate the collection of quitrents. The Quitrent Act of 1731 required the registration of land grants issued during the proprietary period so as to validate the grants and establish an effective system to collect the rent (quitrents) due on the land. Later legislation provided for the registration of royal grants. The landholder was to present to the Auditor General or his Deputy documented evidence of the land title, including the amount of quitrent, but because not all grants were registered and the crown never established a successful mechanism to enforce the law, the payment of quitrents basically remained voluntary.

    The system of quitrents and the Auditor General's records end in the mid-1770s with the impending collapse of the royal government.

    This series consists of the registrations of land titles which were authorized by the Quitrent Act of 1731 to serve a dual purpose: 1) validating land grants made by the Lords Proprietors, and 2) establishing a more efficient system of collecting quitrents. The documentation provided by the landowner to the Auditor General's office could be either recorded in full or in an abstract, called a "memorial." The full recordings are contained in volumes 1, 2, and 3 of the original series and volumes 1, the first 251 pages of volume 2, and volume 4 of the copy series. Eventually both forms became known as memorials.

    Most of the documents are exact copies or abstracts of grants, but also included are plats and certificates of survey, deeds of gift, leases and releases, renunciations of dower, and wills. The copies of plats from the proprietary period are particularly valuable because few other plats from that period survive. Information contained in the original volumes and a copy set of the volumes completed in 1821 includes names of the memorialist, persons associated with the title, surrounding landowners, and surveyors; descriptions of the property; and dates of recording. The last portion of volume 14 of the copy series also includes certificates for town lots in Beaufort registered by the Surveyor General between 1743 and 1774 for the purpose of enforcing an act of 1740 that required the collection of fines on unimproved lots in Beaufort.", South Carolina Department of Archives and History, 8301 Parklane Road, Columbia, South Carolina, USA.
